Referral Program Terms and Conditions

Our Referral Program Terms and Conditions outline the agreement between Elite Vivant and Referral Partners, specifying the obligations, compensation, and referral process, among other important details. By participating in our program, you agree to these terms.

 

1. Introduction

This Referral Program Agreement (“Agreement”) is entered into by and between Elite Vivant (“Agency”) and [Referral Partner’s Name] (“Referral Partner”). By participating in the Agency’s referral program, the Referral Partner agrees to the terms and conditions outlined in this Agreement. Please read this document carefully.

2. Referral Relationship

2.1. Referral Partner Obligations: The Referral Partner agrees to refer potential clients to the Agency who may benefit from the services offered by the Agency.

2.2. Compensation: In consideration for successful referrals, the Agency agrees to provide the Referral Partner with the compensation detailed in Section 3 of this Agreement.

3. Referral Process

3.1. Referral Submission: The Referral Partner shall submit referrals to the Agency through the designated referral method, which may include, but is not limited to, email introductions, or social media provided by the Agency.

3.2. Qualified Referrals: A qualified referral is a potential client referred by the Referral Partner who meets the criteria established by the Agency.

3.3. Non-Qualified: A non-qualified referral is one that the Agency is already connected to.

4. Compensation

4.1. Amount: The Agency will compensate the Referral Partner as follows:

  • Option 1: You’ll receive a one-time commission equal to 10% of the total project sale generated by the referred customer on their first project.

  • Option 2: With the 15% Elite Vivant Credit option, you can choose to reinvest your commission back into another Elite Vivant service.

4.2. Payment: Payment will be made by the Agency to the Referral Partner within 3-5 business days after the full invoice is paid by the referred client.

5. Tax Reporting

5.1. W-9 Requirement: The Referral Partner agrees to complete and submit a valid W-9 form to the Agency upon entering into this Agreement. The Agency will use the information provided on the W-9 form for tax reporting purposes, including the issuance of a 1099 form at the end of the calendar year.

6. Term and Termination

6.1. Term: This Agreement shall commence on the effective date and shall continue until terminated by either party in writing.

6.2. Termination: Either party may terminate this Agreement for any reason upon written notice.

7. Confidentiality

7.1. Both parties agree to maintain the confidentiality of any client information and other proprietary information shared during the course of this Agreement.

8. Governing Law

8.1. This Agreement is governed by the laws of California, and any disputes arising from or related to this Agreement shall be resolved in accordance with the laws of that jurisdiction.

9. Entire Agreement

9.1. This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements or understandings, whether written or verbal.

10. Amendment

10.1. Any modifications to this Agreement must be made in writing and signed by both parties.

11. Independent Contractors

11.1. Both parties acknowledge that they are independent contractors and that this Agreement does not create an employer-employee relationship.
